With little evidence besides an operative report written by the surgeon himself, it can be very hard to prove that unreasonable skill or judgment caused a bad surgical outcome. We have been most successful in suing a surgeon for doing unnecessary surgery or for delaying the diagnosis of a post-operative complication.
