Since October 1973, Michigan has had a No-Fault Automobile Insurance law. What does that mean? If you are in a “motor vehicle” accident, Michigan’s no-fault law provides some extremely valuable benefits. It also has some strict limitations. The law is very complicated with hundreds of court decisions interpreting it. Under Michigan’s No-Fault law, you can only sue an at-fault driver for causing “serious impairment of bodily function,” “permanent, serious disfigurement,” or death. How high is that “serious impairment” threshold? Under Michigan Automobile No-Fault Insurance law, you may be entitled to get reimbursed for some of the expenses you incur as a result of the motor vehicle accident, regardless of who was at fault in the accident (that is why the law is called “No Fault”). Generally, the three most important no-fault ‘Personal Injury Protection” (PIP) insurance benefits you will receive are:

  1. Lifetime medical expenses, prescriptions, medical appliances, attendant care by family members or others, home modifications, rehabilitation, transportation, reimbursement for the miles you drive to and from the doctor or therapist, and other “reasonable charges incurred for reasonably necessary products, services and accommodations for an injured person’s care, recovery or rehabilitation.”

  2. Work Loss for “loss of income from work an injured person would have performed during the first three years after the date of the accident if he or she had not been injured.” You will receive 85% of your gross wages (before tax). There is a monthly maximum that is adjusted for inflation. Even if you were temporarily unemployed, you are entitled to wage loss benefits if you would have worked but for your injuries.

  3. Replacement Services of up to $20 per day for expenses incurred to pay family, friends, neighbors or anyone else who performs “ordinary and necessary services in lieu of those that, if [you] had not been injured, [you] would have performed during the first three years after the date of the accident, not for income but for the benefit of [yourself] or [your] dependents.” Examples are cooking, cleaning, yard work, childcare, etc. A doctor may have to certify that the service is necessary. You must keep good records of what services were performed for you while you were injured. And, you must submit these requests for reimbursement for services to your PIP insurer.

In addition to these no-fault “Personal Injury Protection” (PIP) benefits, if a motor vehicle accident causes the death of a family member, you may be entitled to reimbursement of some or all of the funeral and burial expenses, the medical bills and survivor’s loss benefits to the dependants of the decedent. These payments will be made for up to three years to the spouse, minor children and other dependants of the decedent for the loss of “contributions of tangible things of economic value” such as loss of after-tax wages, loss of fringe benefits, and up to $20 per day in replacement household services (all subject to a monthly maximum). Also, the Act provides “Property Protection Insurance” (PPI) to reimburse for expenses to repair, or possibly replace, certain types of accidentally damaged property such as a gas pump, fence, etc. (but not the other car, unless it was legally parked).
