Ohio Legal Malpractice Settlement
Of all the cases we have handled, few have lasted as long, or been as hard-fought, as a legal malpractice case against a trial judge in Ohio.
Shortly before being elected as a judge, an attorney in Southern Ohio was representing our client in an estate matter. He did not file timely or accurate tax returns for the estate. When an attempt was made to settle the claim before suit was brought, the judge and/or his insurer refused and cast blame on the family and their accountant. The case was brought, then promptly dismissed by a fellow judge in the same county. We appealed and won in the Court of Appeals.
Defendant then appealed to the Ohio Supreme Court, but we won again and the case was sent back to the trial court where Defendant now realized he would have to pay the six-figure economic damages caused to the family.
This settlement helps show the power of working in multiple states. None of the local lawyers the family contacted before us would take the case against a sitting judge. With a geographically diverse practice, we were able to take the case and ultimately get the family the justice they deserved.
