Medical or Legal Malpractice

Malpractice means negligence by a professional. A doctor or hospital can be sued for failing to order tests, missing a diagnosis, delaying treatment or other unreasonable conduct which causes injury to a patient. Likewise, a lawyer may commit a malpractice if he misses a deadline or otherwise breaches his professional duties - thus costing you money. Malpractice cases are almost always very hotly contested. Class Actions

Class actions are lawsuits where one person, who individually may have only suffered a minor loss, represents a large group of individuals with a similar problem. False advertising can lead to a large recovery for a group of deceived consumers. Michigan and Ohio have some very strong laws regulating advertising. For example, Michigan law requires all terms and conditions to be stated in equal prominence with the word "free." Unfortunately, many businesses do not obey the law. Some ads hide the terms and conditions in the fine print. Even worse, some ads require you to go to the store before you learn the terms and conditions. Using the word "free" in this way is an unfair and deceptive action and is a violation of Michigan's Consumer Protection Act.

Steven E. When an appliance store promised "Free Airfare for Two" to Florida, Bahamas or Hawaii with a purchase over $200, we sued. It sounded too good to be true and it was. There were so many restrictions, taxes and other conditions that the offer itself was worthless. After our firm stepped in, a class of 30,000 Michigan consumers obtained compensation.

A good case involves a business that is well established and won't disappear or declare bankruptcy as soon as a lawsuit is filed. Ideally, many consumers will have suffered the same loss, even if no one consumer has suffered a great harm. There are many factors that must be examined in deciding whether to bring a class action. Examples of possible cases include using the word "free" without disclosing in the ad all the terms and conditions (the cellular phone companies regularly violate this law), unauthorized fees (e.g. a mortgage company making you pay to find out the payoff amount, or to record the mortgage release), and unfair or hidden charges for using a service (if you have paid for a 900 call to a psychic, we would like to hear from you - you probably have a case).
